{"id":1289,"date":"2024-05-29T09:11:17","date_gmt":"2024-05-29T09:11:17","guid":{"rendered":"https:\/\/sbert-jaume.com\/?p=1289"},"modified":"2024-05-29T09:11:20","modified_gmt":"2024-05-29T09:11:20","slug":"la-legalizacion-de-viviendas-en-suelo-rustico-ya-es-posible","status":"publish","type":"post","link":"https:\/\/sbert-jaume.com\/es\/la-legalizacion-de-viviendas-en-suelo-rustico-ya-es-posible\/","title":{"rendered":"LA LEGALIZACI\u00d3N DE VIVIENDAS EN SUELO R\u00daSTICO YA ES POSIBLE"},"content":{"rendered":"<div id=\"bsf_rt_marker\"><\/div>\n<p>Mucho se ha hecho esperar desde que en mayo el a\u00f1o pasado cuando el futuro nuevo gobierno gan\u00f3 las elecciones. Desde entonces han corrido r\u00edos de tinta y muchos rumores entre los profesionales del sector sobre c\u00f3mo y cu\u00e1ndo se publicar\u00eda la nueva normativa. Pues bien, hoy 28 de mayo de 2024 tenemos, por fin la norma que regula el procedimiento de legalizaci\u00f3n extraordinario de edificaciones, construcciones, instalaciones y usos existentes en suelo r\u00fastico. De esta norma podemos destacar los siguientes puntos:<\/p>\n\n\n\n<p>1.-\u00a0<strong>Legalizaci\u00f3n en suelo r\u00fastico general:<\/strong>\u00a0Es posible siempre que las infracciones hayan prescrito y no se pueda iniciar ning\u00fan expediente de demolici\u00f3n, no se tendr\u00e1n en cuenta los par\u00e1metros urban\u00edsticos y el plazo para hacerlo ser\u00e1 de 3 a\u00f1os.<\/p>\n\n\n\n<p>2.-\u00a0<strong>Legalizaci\u00f3n en suelo protegido:<\/strong>\u00a0ser\u00e1 posible si la infracci\u00f3n ha prescrito y se acredita que las obras exist\u00edan acabadas anteriormente al 10 de mayo de 1991. Si no se puede acreditar, no se podr\u00e1 legalizar.<\/p>\n\n\n\n<p>3.- \u00bf<strong>Qui\u00e9n, d\u00f3nde y c\u00f3mo se inicia este tr\u00e1mite?<\/strong>\u00a0El propietario es quien deber\u00e1 presentar la solicitud de legalizaci\u00f3n ante el Ayuntamiento correspondiente mediante la presentaci\u00f3n de un proyecto t\u00e9cnico. dicho proyecto deber\u00e1 incorporar medidas de car\u00e1cter medioambiental, prevenci\u00f3n de contaminaci\u00f3n lum\u00ednica, eficiencia energ\u00e9tica, energ\u00eda renovable, instalaci\u00f3n de dep\u00f3sitos de agua y de depuraci\u00f3n.<\/p>\n\n\n\n<p><strong>4.- \u00bfHay un plazo m\u00e1ximo?<\/strong>\u00a0S\u00ed, de 3 a\u00f1os desde la entrada en vigor de esta norma.<\/p>\n\n\n\n<p>5.-\u00a0<strong>\u00bfHay que abonar alguna tasa?<\/strong>\u00a0Se tendr\u00e1 que abonar las mismas tasas que implicar\u00eda una construcci\u00f3n nueva. Tambi\u00e9n se exigir\u00e1 una contraprestaci\u00f3n adicional dependiendo de cuando se pida la legalizaci\u00f3n: del 10% el primer a\u00f1o, del 12,5 el segundo a\u00f1o y del 15% el tercer a\u00f1o. La base para su c\u00e1lculo ser\u00e1 el coste de ejecuci\u00f3n material de la edificaci\u00f3n.<\/p>\n\n\n\n<p>6.-\u00a0<strong>\u00bfExiste alguna limitaci\u00f3n?<\/strong>\u00a0No todas las propiedades podr\u00e1n sujetarse a este r\u00e9gimen. Especialmente si tienen que ser objeto de expropiaci\u00f3n o cesi\u00f3n o se encuentran en dominio p\u00fablico, como por ejemplo en Dominio p\u00fablico mar\u00edtimo terrestre.<\/p>\n\n\n\n<p>7.-\u00a0<strong>\u00bfEn cu\u00e1nto tiempo se tramitar\u00e1 la licencia?<\/strong>\u00a0Se establece un plazo de 6 meses para que se tramite la licencia. La no contestaci\u00f3n por parte de la administraci\u00f3n se entender\u00e1 como NO concedido.<\/p>\n\n\n\n<p>8.-\u00a0<strong>Limitaci\u00f3n con la licencia de vivienda vacacional:<\/strong>\u00a0La concesi\u00f3n de esta legalizaci\u00f3n extraordinaria requerir\u00e1 el compromiso de no destinar la vivienda tur\u00edstica y a su inscripci\u00f3n en el registro de la propiedad.<\/p>\n\n\n\n<p>Finalmente, existe otro apartado interesante y es que la norma deroga los art\u00edculos 4 y 5 del Decreto Ley 9\/2020 en el cual se prohib\u00eda la construcci\u00f3n de las zonas de prevenci\u00f3n de riesgo (APR) y la eliminaci\u00f3n de los l\u00edmites de construcci\u00f3n. Entendiendo que ahora se volver\u00e1 a los antiguos par\u00e1metros de construcci\u00f3n, es decir, un 4% de ocupaci\u00f3n y a 1500 metros c\u00fabicos de construcci\u00f3n.
